Having heard learned counsel for the parties and having perused the record, it is evident that general allegation of demand of dowry and committing cruelty in lieu thereof has been levelled against all the accused persons in the first information report as well as in the statement of the prosecution witnesses. In the F.I.R., it is specifically stated that it was on 22.05.2020, the accused Jai Prakash (husband of the deceased) had taken the deceased with him and as per confession of Jai Prakash, it is confessed that he had committed murder of the deceased in a jungle and left the dead body there. The postmortem report also suggests that the dead body was found in badly deteriorated condition and thus, the cause of death could not be ascertained. It is also submitted on behalf of the applicant that the applicant, who is ' jethani' of the deceased, was living separately with her husband and emphasis has been given on the ration card placed at page 118 of the paper book. Initially the applicant was not charge-sheeted, however, it was after further investigation, the complicity of the applicant has been found on the basis of two witnesses, whose statement was recorded on 24.10.2020. Charge-sheet in this case has already been filed. Applicant is in jail in this case since 30.11.2021 without any previous criminal history. The presence of the applicant could be secured before the trial court by placing adequate conditions.
