Heard Sri Rajesh Kumar Mishra, learned counsel for the applicant, Sri Devansh Rathore, learned counsel for the opposite party, learned A.G.A. and perused the record.

The instant bail application has been filed on behalf of the applicant- Subhash with a prayer to release him on bail in Case Crime No.279 of 2021, under Sections 420, 406, 467, 468, 471 and 120-B I.P.C., Police Station- Khurja Nagar, District- Bulandshahar during pendency of trial.

Learned counsel for the applicant submitted that the first information report has been lodged on 5.4.2021 in respect to the sale deed executed on 22.9.2011 i.e. after 10 years back. On the basis of alleged execution of the sale deed, mutation was applied also in the year 2011. He further submitted that the money was advanced to co-accused persons- Vikrant Wadhawa and others. He next submitted that the first informant is in possession of the land in question on the basis of alleged execution of the sale deed. He further submitted that there are no chances of applicant's fleeing away from the judicial process or tampering with the prosecution evidence, and is in jail since 2412.2021 and he has no criminal antecedent.
