Learned counsel for the applicant submits that the FIR has been lodged against unknown persons by wife of the deceased, who is the applicant in the present case. He further submits that name of the applicant surfaced in the confessional statement of co-accused Sachin, which cannot be read in evidence. He further submits that name of Sachin surfaced in the statement of witness Deepu @ Tushar. Apart from the confessional statement there is no direct or indirect evidence to connect the applicant with the present case. Thus, it is a no evidence case. Applicant is languishing in jail since 10.12.2020. She does not have any previous criminal history. In case she is released on bail, she will not misuse the liberty of bail and will cooperate in trial. Learned counsel for the applicant further submits that coaccused of this case namely, Sachin with whom applicant had illicit relationship has already been granted bail by the coordinate Bench of this Court, vide order dated 30.07.2021 in Criminal Misc. Bail Application No.24841 of 2021, therefore the applicant is also entitled to be released on bail on the ground of parity.
