Learned counsel for the applicant submits that earlier, the brother of deceased lodged missing report on 13.05.2021 mentioning therein that his brother is missing since 01.05.2021. On the very next date i.e. 14.05.2022, the FIR has been lodged against six named accused persons including the applicant, wherein it has been mentioned that on 10.05.2021 at 10 O'clock, the informant's brother had gone to purchase cattle to Khalilabad, Gorakhpur. On 09.05.2021 and 12.05.2021, Irfan @ Funti called on the mobile of the informant stating therein that his brother had taken Rs.5 Lacs related to business being done together, and is not returning the same. He also warned him that in case his brother does not return the money, he would be killed by him. On 11.05.2021, all the accused persons came to the informant's house raising a demand from Iqbal to return money. On 12.05.2021, all the accused persons met at the place of Shakeel Qureshi in order to settle the monetary dispute between informant's brother and Irfan @ Funti. At that time, Zahid and Waseem were also present at the aforesaid place. Later on 14.05.2021, the body of informant's brother was found below the bridge, therefore, the present FIR has been lodged under suspicion that the brother of the deceased has been done to death by the aforesaid accused persons due to dispute between them and for the same, the accused persons have given life threat to the informant's brother.
