Heard learned counsel for the applicant; Sri Dilip Kumar Shukla, Advocate, holding brief of Sri Mohit Singh, learned counsel for the informant; learned AGA for the State and perused the material placed on record.
The instant bail application has been filed on behalf of the applicant, Sonu, with a prayer to release him on bail in Case Crime No.678 of 2018, under Sections 302, 394, 411, 201, 120-B IPC, Police Station Civil Lines, District- Budaun, during pendency of trial.
There is allegation against the applicant of committing the offence of murder and causing injury for the purpose of robbery. The alleged amount of Rs.20 lacs has been allegedly recovered from the applicant.
Learned counsel for the applicant has submitted that the applicant was not named in the FIR. He has been falsely implicated in this case on the basis of planted recovery. Four prosecution witnesses have been examined before the trial court, but no one has named the applicant. The applicant has no criminal history to his credit and is languishing in jail since 15.10.2018. The trial in the aforesaid case is not likely to be concluded in near future.
