The submission of the learned counsel for the applicant is that the applicant is innocent and has been falsely implicated in the present case. The police has allegedly recovered 1 kg opium from the possession of the applicant. It is submitted that the alleged recovered narcotic is below the commercial quantity. It is further submitted that provisions of Section 50 NDPS Act were not complied with. There is no public witness of the recovery, however, the recovery is shown from a public place. It is averred that the applicant is a respectable lady and has no criminal antecedent to her credit. It is submitted that coaccused, Laxmi Devi, similarly circumstanced as the applicant, has already been enlarged on bail by another co-ordinate bench of this Court vide order dated 16.11.2022 passed in Criminal Misc. Bail Application No. 51166 of 2022, entitling the applicant to be released on bail on the ground of parity. It is in the last submitted that the applicant is languishing in jail since 01.10.2022 and in case she is released on bail, she will not misuse the liberty of bail.
