Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the present case due to ulterior motive. In her statement recorded under Sections 161 Cr.P.C., she states that she is studying in Class 9th, her date of birth is 11.12.2007, she was friendly with the applicant since last six months, she states the age of the applicant to be 18 years old. She has further stated that she had left her house on 22.07.2022 to go and meet the applicant. She went alongwith applicant out of her own sweet will to Shahjahanpur, where they performed marriage in a temple. As the family members of the applicant did not accept the aforesaid marriage, they started living in a rented house. She loves Vineet, the applicant. As she was missing her family members she came to her parents house. He further submits that in her statement recorded under Section 164 Cr.P.C., she has stated that she has established physical relationship with applicant out of her own free will.
