Learned counsel for the applicant has argued that a first information report has been lodged by one Smt. Poonam Gautam w/o Sri Arvind Kumar Sharma under Section 420 IPC and Sections 66C and 66D of Information Technology (Amendment) Act, 2008 being FIR no.0122 on 27.6.2021 at 23:04 hours, against the unnamed persons with an allegation that she received certain message and during the course of the conversation, she was directed to give certain personal details, which she had given thereafter an amount of Rs.96817/-, which was sought to be debited from his account. Learned counsel for the applicant has further submitted that the only basis for implicating the applicant is that he received Rs.25000/- from the third person, whose phone number was there. Learned counsel for the applicant has further argued that he has been falsely implicated in the case in question, he, at no point of time, has committed the said offence, the recovery so sought to be made from the applicant is planted one, as the said amount belongs to him. Learned counsel for the applicant has further drawn the attention of this Court towards paragraph-18 of the bail application so as to contend that the applicant possesses no criminal history and is unnecessarily languishing in jail since 17.7.2021. If the applicant is released on bail, he will not misuse the liberty of bail, he be enlarged on bail.
