Having considered the rival submissions made by learned counsel for both the parties and on perusal of the record, it is evident that the statements of both the victims have been recorded during the course of trial. In her statement the first victim has not supported the prosecution story at all and has been declared hostile. On her attention being drawn to her statement shown to be recorded under Section 161 Cr.P.C, first victim has categorically stated that she has not given any such statement to the police. During cross examination also she has categorically stated that neither Raju nor applicant- Sandesh had committed raper on her. The statement of second victim has also been recorded during the course of trial and she in her statement has not supported the prosecution story at all and has been declared hostile. On her attention being drawn to her statement shown to be recorded under Section 161 Cr.P.C, second victim has categorically stated that she has not given any such statement to the police, as such she has been declared hostile. During the cross examination, she has also denied the factum of committing rape upon the victim, even in cross examination, she has completely denied the statement shown to be recorded under Section 161 Cr.P.C. During the course of trial, P.W.-1 father of the victims has also not supported the prosecution story and has been declared hostile. Even in cross examination, he has not supported the prosecution story at all.
