Heard learned counsel for the applicant, learned A.G.A for the State and perused the record.
It is submitted by learned counsel for the applicant that he is innocent and has been falsely implicated in the present case by the police. Recovery of ATM cards and Rs. 1120/- is totally false. No any F.I.R. has been lodged about theft of ATM cards said to be recovered from the possession of applicant. There is no any previous criminal history against the applicant. Only two cases are shown, those are related to present incident. He is languishing in jail since 10.09.2021 and in case he is released on bail, he will not misuse the liberty of bail and will cooperate in trial.
Learned AGA opposed the prayer for bail.
Keeping in view the nature of the offence, evidence, complicity of the accused, submissions of the learned counsel for the parties and without expressing any opinion on the merits of the case, the Court is of the view that the applicant has made out a case for bail. The bail application is allowed.
Let the applicant Ajeet Kumar involved in Case Crime No. 194 of 2021, under Sections 379, 411, 413, 414, 420 I.P.C., P.S. Gambhirpur, District Azamgarh be released on bail on furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned subject to following conditions.
In case of breach of any of the above conditions, the prosecution shall be at liberty to move bail cancellation application before this Court.
