Learned counsel for the applicant argued that the applicant is the father-in-law of the deceased Smt. Somil. It is argued that the deceased committed suicide and died, which is suggestive from the post mortem report, in which the doctor did not find any external injury on her body and could not ascertain the cause of her death and as such viscera was preserved. The viscera report is still awaited. It is further argued that there are general and omnibus allegations in the FIR against the applicant and other co-accused persons. The entire family members of the applicant have been made as accused. Sri Awadesh Tiwari, husband of the deceased is in jail. It is further argued that Smt. Kamla, mother-in-law of the deceased has been granted bail by a co-ordinate Bench of this Court vide order dated 04.12.2021, passed in Criminal Misc. Bail Application No.42957 of 2021 (Kamla Vs. State of U.P.) and further Ashok alias Aneesh Tiwari, Devar of the deceased has also been granted bail by a co-ordinate Bench of this Court vide order dated 17.11.2021, passed in Criminal Misc. Bail Application No.33574 of 2021 (Ashok alias Aneesh Tiwari Vs. State of U.P.). Copies of the orders have been placed before the Court, which are taken on record. It is next argued that the applicant is an old person aged about 64 years. Paragraph 21 of the affidavit filed in support of the bail application has been placed before the Court. Lastly, it is argued that the applicant is having no criminal history as stated in paragraph 20 of the affidavit and is in jail since 27.06.2021.
