Learned counsel for the applicant has argued that the applicant is absolutely innocent and has been falsely implicated in the present case with a view to cause unnecessary harassment and to victimize him. Learned counsel submits that the applicant is not named in the first information report. After expiry of two months from the date of lodging of the aforesaid first information report the applicant along with other three co-accused were arrested by the police when he was sleeping in his house on 18th August, 2022. A complaint in that regard has been made by the wife of the applicant to the Hon'ble The Chief Justice, High Court, Allahabad and the Senior Superintendent of Police, Prayagraj through registered post on 20th August, 2022. It is further submitted that on 22nd August, 2022, Rs. 1,80,000/- is alleged to have been recovered from the joint possession of the four accused persons including the applicant and ornament from one Goldsmith, namely, Anil is alleged to have been recovered. It is next argued by the learned counsel for the applicant that the alleged recovery is planted one by the Police. There is no independent witness of the alleged recovery. No identification of the alleged recovered cash and ornament has been done by the Police. It is lastly submitted that the co-accused, namely, Fateh Khan and Saleem have already been granted bail by the Additional District and Sessions Judge/Additional Special Judge (POCSO)-First, Allahabad vide order dated 21st September, 2022, a copy of which has been brought on record at page-40 onwards of the paper book. The case of the present applicant is more or less identical to that of the aforesaid co-accused. As such the present applicant is also liable to be enlarged on bail. The applicant has two criminal antecedents to his credit except the present one but the same have satisfactorily been explained in paragraph-10 of the affidavit accompanying the present bail application.
