Learned counsel for the applicant has argued that a first information report has been lodged by one Rinki Yadav wife of Rajesh Kumar before P.S. Chaubia, Etawah being FIR No. 0123 of 2021 under Section 392 IPC on 18.8.2021 at 17:57 hours against the unknown persons with allegation that when the complainant along with his brother was coming going to inlaws house, along with two children, then the accused, who have been shown to be unknown in the FIR, snatched the gold chain and other valuables. Learned counsel for the applicant has argued that in the applicant has been falsely implicated in the case in question. He was not named in the FIR, however, recovery has been sought to be shown referable to a countrymade pistol. Learned counsel for the applicant has further argued that applicant has not committed the offence, recovery is planted one, as there was no independent witness. Learned counsel for the applicant has further argued that he has properly explained the criminal history in paragraph-7 so as to contend that in Bail Application No. 42010 of 2021, Sonu Sharma vs. State decided on 4.12.2021, he has been bailed out in Case Crime no. 194 of 2021 while further referring to page -17 being order dated 7.9.2021 in Bail Application No. 1972 of 2021 passed by the court below in Case Crime no. 302 of 2021, he has been bailed out.
