Learned counsel for the applicant has next submitted that applicant is not named in the FIR, however subsequently, in the statement of the victim recorded under Section 161 CrPC, she has categorically stated that she is 16 years of age and on 30.03.2022 at 6:00 PM, she had gone at Domingarh Taxi Stand, as she wanted to visit her mother at Maharajganj. There, she boarded a taxi and reached Gorakhpur, where she met an unknown boy, who wanted to entice her away along with his friends, however, she refused to go with them and somehow made her escape good and reached at the Railway Station, where officials of Child Line met her and took her in their custody. Subsequently, in her statement shown to be recorded under Section 164 CrPC, she has improved her version and stated that while she was going to her mother's house at Maharajganj and reached Gorakhpur, an unknown boy met her and enticed her away to a secluded place on the assurance that he will drop her at her house and thereafter, his two friends also joined him and they committed rape on her at an unknown place and left her at the Railway Station, where from, she was taken away and kept at Child Care Centre and later, taken away by her mother.
