Learned counsel for the applicant submits that the applicant is innocent and she has been falsely implicated in the present case. He next added that the applicant herself has been duped by other persons, who has been given forged allotment letter to him and the applicant was not aware of the fact that the same is allegedly forged. He next added that on the basis of the alleged allotment letter, she had taken possession of the house in question and later on when dispute arose, she showing her bonafide, surrendered the same vide letter dated 14.10.2022. Next submits that she has handed over the house in question to the Supervisor of LDA namely Vinod Kumar and she is not in possession of the house. He next added that, in fact, the informant, as per the first information report, has allegedly purchased the aforesaid house and the present applicant assailed the sale deed by filing a civil suit for permanent injunction though that was dismissed, thereafter a review was filed which is pending consideration. He added that dispute is civil in nature and that is being given colour of criminality.
