It has been argued by learned counsel for the applicant that applicant is innocent and he has been falsely implicated in the present case. It is submitted that as per the version of the first information report, on 09.04.2022 applicant along with his nephew Rohit stayed for 3-4 days at the residence of the informant. On 13.04.2022, the applicant abducted his younger sister, aged 17 years. In this regard, he was informed by his another younger sister Gulshan and daughter-in-law Kalpna. The applicant is the uncle (Mausa) of the informant. It is submitted that the victim in her statement under Section 161 and 164 Cr.P.C. have not supported the prosecution version and that she is a consenting party. It is also submitted that the victim has denied for her medical examination, thus, applicant has not committed any offence as alleged in first information report. It is further submitted that applicant is languishing in jail since 19.07.2022 having no criminal history and that in case he is released on bail, he will not misuse the liberty of bail and will cooperate in trial.
