The submission of the learned counsel for the applicant is that he is innocent and has been falsely implicated in the present case. The applicant is not named in the FIR. It is stated that on the date of occurrence, the applicant was at his home. He was not present on the spot. It is submitted that there is no public witness in support of the prosecution case. There is no evidence against the applicant. It is next submitted that no specific role has been assigned to the applicant and a general role has been assigned to all the accused. It is fairly submitted that applicant has criminal history of two cases, namely, Case Crime No. 43 of 2022, under Sections. 147, 148, 149, 153, 307, 323, 333, 336, 504, 506, 153A, 427, 120B, 109, 34, 327 I.P.C. and Section 7 Criminal Law Amendment Act, Police Station Bekanganj, District kanpur Nagar and Case Crime No. 42 of 2022, under Sections 147, 148, 149, 153, 307, 323, 332, 333, 336, 353, 427, 504, 506, 120B, 109, 34, 153A I.P.C. and Section 7 Criminal Law Amendment Act and Section 3/4 Prevention of Damage to Public Property Act, Police Station Bekanganj, District Kanpur Nagar. In both the cases, the applicant is on bail, copies of the bail orders has been supplied today in the Court, which are taken on record. It is further submitted that coaccused Saiyad Anas Hasan, who was named in the FIR, has already been released on bail by another co-ordinate bench of this Court vide order dated 11.10.2022 passed in Criminal Misc. Bail Application No. 39686 of 2022 entitling the applicant to be released on bail on the ground of parity. It is in the last submitted that the applicant is in jail since 06.06.2022 and in case he is released on bail he will not misuse the liberty of bail.
