It has been contended by the learned counsel for the applicant that applicant has been falsely implicated in the present case. It is next submitted that as per F.I.R. version, gang leader Deepak Kumar Pasi had an organized group and the applicant was also an active member of the said group. It is further mentioned that members of the gang are engaged in committing theft and robbery. It is further submitted that from bare perusal of the contents of the F.I.R., it is obvious that main role of running the alleged gang was assigned to co-accused Deepak Kumar Pasi and the applicant had no role in running the said gang. It is further submitted that three cases have been shown against the applicant in the Gang Chart, which have been annexed as Annexure No. 2 to the affidavit filed in support of the bail application and in the said cases, the applicant has been granted bail by the competent Court, the said fact has been mentioned in para nos. 6, 7 and 8 to the affidavit filed in support of bail application and out of these three cases, accused-applicant was not named in the F.I.R. in two cases. All the F.I.R.s in question relate to P.S. Bhadohi, District Bhadohi, whereas gang chart has been prepared from P.S. Chauri, District Bhadohi. It is further submitted that there is no evidence on record to prove the alleged offences against the applicant. The applicant is in jail since 20.7.2022.
