Learned counsel for the applicant submits that applicant is innocent and has been falsely implicated due to ulterior motive. It is further submitted that a concocted and false story has been set up by the prosecution whereas the applicant has not committed any offence as alleged. It is next submitted that there is no credential evidence against the applicant which may show involvement of the applicant in the present case. There is no independent reliable eye witness of the alleged incident. It is next submitted that there is various contradictions in the version of F.I.R. as well as statement s recorded under section 161 and 164 Cr.P.C. Several other submissions in order to demonstrate the falsity of the allegations made against the applicant have also been placed forth before the Court. Learned counsel for the applicant further submits that co-accused of this case namely, Shyamveer having similar role has been granted bail by the co-ordinate bench of this Court, vide order dated 19.07.2022 in Criminal Misc. Bail Application No.54385 of 2021, therefore the applicant is also entitled to be released on bail on the ground of parity. The applicant is languishing in jail since 13.07.2022. The applicant does not have any previous criminal history. In case, he is released on bail, he will not misuse the liberty of bail and will cooperate in the trial by all means. Lastly, it is submitted that there is no chance of applicant fleeing away from judicial process or tampering with the witnesses.
