It has been argued by learned counsel for the applicant that applicant is innocent and he has been falsely implicated in the present case. The first information report was registered against 7 unknown persons. The informant in his statement under Section 161 Cr.P.C. did not disclose the name of the any accused-applicant. The names of the applicants surfaced during the investigation from the statements of Shriramji and Ramsiya along with the names of other accused persons namely Meenu Kanjad, Sheenu, Nandu, Deepak, Kaluva, Bachchu Chamar. The accused applicants were arrested on 05.05.2022 and from the possession of the applicant-2 Arvind one country made pistol, Rs.900/- and one mobile phone were alleged to have been recovered whereas from the possession of another applicant Ashok, Rs.900/- was alleged to be recovered. On 06.05.2022, on the pointing out of the applicant Arvind, two pieces of crown (mukut), four pieces of bracelet, 16 pieces of rings of white metal, five pieces of chain of white metal and 25 pairs of anklet of white metal measuring 1.5 kg were shown to be recovered while on the pointing out of the applicant Ashok 12 pairs of anklet measuring 850 gms, were alleged to be recovered. It is submitted that co-accused persons namely Seenu @ Chandrashekhar, Dan Singh, Deepak Kanjar and Nandu @ Pawan have already been enlarged on bail vide Criminal Misc. Bail Application Nos. 34579 of 2022, 35931 of 2022 and 34591 of 2022, copies of which have been produced before this Court and the same are taken on record. He further submits that since the role of the applicant is identical to that of the co-accused who have already been enlarged on bail, he is also entitled to be enlarged on bail on the ground of parity.
