From the perusal of record, it reveals that the applicant is not named in the F.I.R., his name has been surfaced during investigation. Nothing incriminating has been recovered from the possession of the applicant. Co-accused Harendra Yadav, Sanjay Yadav, Adarsh Singh @ Nilesh, Vikas Kumar and Joshi who are also not named in the F.I.R. have already been granted bail by the coordinate Bench of this Court vide orders dated 10.08.2022, 16.08.2022, 05.09.2022, 18.08.2022 and 10.08.2022 passed in criminal misc. bail application nos. 33533, 33064, 34417, 34719 and 33552 of 2022. Applicant has no criminal history. Grounds taken in the bail application are sufficient. Hence, keeping in view the nature of the offence, evidence, complicity of accused, severity of punishment, submissions of the learned counsel for the parties, the dictum of Apex Court in the case of Dataram Singh vs. State of U.P. and another, (2018) 3 SCC 22 and without expressing any opinion on the merits of the case, the Court is of the view that the applicant has made out a case for bail. The bail application is allowed.
