Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record.
The present bail application has been filed on behalf of applicant in Case Crime No. 207 of 2022, under Sections 379, 411 of IPC, Police Station Kotwali Shahar, District Bulandshahr with the prayer to enlarge the applicant on bail.
It has been argued by learned counsel for the applicant that applicant is innocent and he has been falsely implicated in the present case. It is submitted that the joint recovery of motorcycle no.UP 13 AS 9302 is shown to be recovered from the joint possession of the applicant with accused Pradeep @ Bittu. It is submitted that after the arrest of the applicant, complainant imposed many cases upon the applicant which was registered against unknown persons, details of which has been duly explained in para 7 of the bail application, in which, he has been granted bail by Co-ordiante Bench of this Court, copies of the bail orders have been produced before this Court and the same are taken on record. It is further submitted that applicant is languishing in jail since 23.01.2022 and that in case he is released on bail, he will not misuse the liberty of bail and will cooperate in trial.
