Learned counsel for the applicant submitted that this is second bail application on behalf of the applicant and the first bail application of the applicant was rejected by this Bench on 21.06.2022. He next submitted that the first bail application filed by the applicant was dismissed by this Bench only on the sole ground that applicant failed to explain the criminal antecedents as during the course of argument, learned AGA disclosed that apart from the present case, there are as many as four cases pending against the applicant. He next submitted that in the present case applicant is in jail since 19.07.2018 and as per allegation, applicant caused injury to the injured on his neck but when the injured was medically examined at higher center, then the doctor of the center opined that the injury was simple in nature. He further submitted that as injury alleged to have been caused by applicant was found simple in nature, therefore, applicant may be released on bail specially considering the long incarceration of more than four years. He next submitted that the criminal antecedents of the applicant has been duly explained in paragraph nos. 6 and 7 to the affidavit filed in support of present application. He further submitted that apart from the present case and the criminal history of previous cases which have been explained in paragraph nos. 6 and 7 there is no other criminal history of the applicant, therefore, applicant may be released on bail during pendency of trial.
