It has been argued by learned counsel for the applicant that the applicant is innocent and he has not committed any offence. The first information report was lodged against applicant and co-accused Sonu, Monu and Surendra, alleging that they have enticed away the daughter of informant. It was submitted that alleged incident has been shown of 11.03.2022 but after the incident, no case was lodged and later on first information report of this case has been got lodged by moving an application under Section 156 (3) CrPC. Learned counsel submitted that victim is already a married lady and in her statement under Section 161 CrPC she has stated that applicant and co-accused persons have taken her to Talbehat and there applicant has assaulted her and did bad act with her. It was stated that after her recovery, she has stated that no-one has enticed her away. It was also shown that victim has made an application to the police of P.S. Prem Nagar, Jhansi, wherein, she has reiterated that she has left her home due to misbehavior of her family members and no-one has taken her away.
