Heard learned counsel for the applicant, learned Additional Government Advocate for the State of U.P. as well as Sri Rajiv Kumar Singh, learned counsel appearing for the informant and perused the record.
The present bail application has been filed by the applicant seeking bail in Case Crime No. 81 of 2022, under Sections 452, 336, 307, 108, 504 IPC, Police Station- Lalapur Pandeypur, District - Varanasi.
Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the present crime. He further submits that it has been alleged in the FIR that the applicant and other co-accused Munna Singh son of unknown entered in the office of the brother of the informant and asked to provide liquor and on denial, they have fired shot on Brijesh Kumar Singh. The victim has received some injuries due to which, he was admitted in Trauma Centre, BHU. He further submits that the applicant has not opened any fire upon the victim intentionally. He further submits that the applicant has no motive to commit such crime. It is also submitted that there is no apprehension that after being released on bail, the applicant may flee from the course of law or may, otherwise, misuse the liberty of bail and the applicant is in jail since 22.03.2022 and the possibility of conclusion of trial in near future is very bleak.
