pathological examination. Same is in negative. The age of the prosecutrix was determined in the medical examination to be 17 years. Ultimately, the statement of prosecutrix was recorded under Section 164 Cr. P. C. Same is on record as Annexure 7 to the affidavit. During course of investigation, Investigating Officer discovered the scholar register and transfer certificate of prosecutrix, wherein her date of birth has been mentioned as 10.7.2005. The occurrence in question has occurred on 17.7.2021. As such, rosecutrix was aged about 16 years and 7 days on the date of occurrence. Ultimately, Investigating Officer examined the first informant and other witnesses under Section 161 Cr. P. C., who have supported the prosecution story. On the basis of above and other material collected by him during course of investigation, which is substantially adverse to the applicant, he opined to submit charge sheet. Resultantly, Investigating Officer submitted the charge sheet dated 9.9.2021, whereby applicant has been charge sheeted under Sections 363, 376 IPC and Sections 3/4 POCSO Act, P.S. Majhola, District Moradabad.
