It is submitted by learned counsel for the applicant that he is innocent and has been falsely implicated in the present case for committing murder of the deceased, the son of the complainant, who went from his house on 09.06.2022 and did not return back. On 10.06.2022, his dead body was found near to Janhit Mahavidyalaya Jalalpur, Jaunpur. The applicant along with other members of his family have been roped in this case on the basis of suspicion on account of old enmity between both the families regarding enticement of the sister of the applicant. Further submitted that there is no evidence on record to show the complicity of this applicant in committing murder of the deceased. There is no any evidence of last seen on record. During investigation an iron rod is said to be recovered by the I.O. at the instance of the applicant, but it does not corroborate with the injuries found on the person of the deceased, which were stab wounds. In this way no offence is made out against this applicant and he is in jail since 14.06.2022 having no any criminal antecedents. In case he is released on bail, he will not misuse the liberty of bail and will cooperate in trial.
