Heard learned counsel for the applicant and learned A.G.A. for the State.

The applicant seeks bail in Case Crime No. 25 of 2020, under Sections 147, 148, 452, 323, 308 I.P.C., Police Station Sikandra, District Agra.

It is submitted by the learned counsel for the applicant that applicant has been falsely implicated in the present case and he has not committed the alleged offence. It is further submitted that applicant is not named in the F.I.R. No offence under Sections 147, 148, 452, 323, 308 I.P.C. There is criminal history of two other cases, which is explained in paragraph 17 and annexed as Annexure -4 alongwith afÏdavit filed in support of bail application. In the said cases, applicant has been granted bail by the court below on 05.11.2019 and by this Court vide order dated 20.07.2022 and by this Court vide order dated 20.07.2022 in Bail Application No. 30808 of 2022, bail application has been produced in the court, which is taken on record. It is next submitted that there is also no possibility of applicant either fleeing away from the judicial process or tampering with the witnesses. Applicant who is in jail since 18.06.2022, undertakes that he will not misuse the liberty, if granted.
