In this matter, it appears from the record that the victim in her statement under Section 161 and 164 Cr.P.C. has assigned the role of the present applicant in the alleged incident for keeping her, however, no sexual assault has been committed against the victim. It also appears that the informant and the victim were residing as tenant in the house of the present applicant and there were some dispute of rent between the parties. The victim has not been recovered from the possession of the applicant. The applicant is languishing in jail since 05.03.2022. Grounds for bail are sufficient. Hence, keeping in view the nature of the offence, evidence, complicity of the accused, severity of punishment, submissions of the learned counsel for the parties, the dictum of Apex Court in the case of Dataram Singh vs. State of U.P. and another, (2018) 3 SCC 22 , and without expressing any opinion on the merits of the case, the Court is of the view that the applicant has made out a case for bail. The bail application is allowed.
