Learned counsel for the applicant argued that the applicant is innocent; he has been falsely implicated in this very case crime number and is languishing in jail since 07.11.2021; he is of no criminal antecedent; First Information Report of the occurrence was got lodged on the same day of 05.11.2021 at 21.32 p.m. for occurrence of 14.00 P.M. by Hari Shankar, the injured himself, wherein, Devki Nandan @ Bitto, Jitu, Virendra, Dhruv and Bhura, were assigned role of giving assault; name of the applicant is not there; specific role of giving fire arm shot is against Jitu; injuries sustained by the injured is one in number; against rest of the accused persons there is general allegation of giving assault by Lathi Danda and iron rod, subsequently, in the statement the other family members of the applicant were also named with specific accusation of being in company and conspiracy of above occurrence, whereas, no involvement of applicant was there; he has been falsely implicated because of being member of the family; there is no likelihood of applicant's fleeing from course of justice or tempering with evidence in case of release on bail; hence bail has been prayed for.
