Learned counsel for the applicant has stated that he has been falsely implicated in the present case. The applicant is even ready to marry her. The victim is a consenting party. To buttress his argument, learned counsel has placed much reliance on the statement of the victim recorded u/s 164 Cr.P.C. wherein she has categorically stated that the physical relations were entered into between the two on the promise of applicant marrying her. It is also stated in her statement that it is learnt that the applicant is ready to marry her. He has further stated that the marriage could not be entered into as the victim/informant herein is already married to one Anil Uraon s/o Nandu Uraon. To this effect, learned counsel has also placed much reliance to the certificate issued by Gram Pradhan filed as Annexure-6 to the affidavit accompanying with the bail application. Several other submissions in order to demonstrate the falsity of the allegations made against the applicant have also been placed forth before the Court. The circumstances which, according to the counsel, led to the false implication of the accused have also been touched upon at length. The applicant is languishing in jail since 31.5.2022 having no criminal history to his credit, deserves to be released on bail. In case, the applicant is released on bail, he will not misuse the liberty of bail and shall cooperate with the trial.
