Learned counsel for the applicant has argued that a first information report has been lodged by one Sri Shalendra Kumar son of Sri Ramesh Chandra being FIR No.0310 on 11.8.2021 at 06:17 hours, under Sections 420, 466, 467, 468, 471 I.P.C. with relation to commission of offence that the applicant along with others impersonated themselves depicting to be the employees of Roadways and who were capable enough to offer appointment to the complainant and the applicant, thereafter, paid a amount of Rs.20,000/- followed by Rs.20,000/- and Rs.40,000/- and the receipt of the same was also issued, but the employment was not granted. Learned counsel for the applicant has further argued while referring to page-16 of the paper-book so as to contend that on 13.9.2021, the complainant has himself come up with a stand while filing an affidavit that he does not want to proceed with the criminal case, particularly in view of the fact that he has received an amount of Rs.90,000/-. Learned counsel for the applicant has further argued that he has paid Rs.80,000/- including the interest.
