Heard learned counsel for the applicant, learned AGA for the State and perused the material on record.
The applicant seeks bail in Case Crime No. 131 of 2022, under Sections 302, 201, 120-B, 34 IPC, P.S. Faridpur, District Bareilly.
As per prosecution story, on 18.03.2022 in the night son of the informant has been murdered by some unknown persons and dead body was thrown in sugarcane field of one Sripal.
The submission of learned counsel for the applicant is that applicant is applicant has been falsely implicated in this case. It is further submitted that the FIR was lodged on 21.3.2022 after three days without any explanation of delay against unknown persons. It is further submitted that during investigation, the name of the applicant was brought into light on the basis of statement of informant and other witnesses. It is further submitted that there is no other evidence on record to connect the applicant with the commission of murder of the deceased except the extra judicial confession. It is submitted that the applicant has no criminal history and is in jail since 27.03.2022.
