It is submitted that the applicant along with his family members have been falsely implicated in the present case. Allegedly, on 20.10.2018 at about 4.00 p.m., the accused persons came in the house of informant having lathi, danda and tabal and caused injuries to the mother of informant with regard to a dispute occurred between the children of both the family. It is further submitted that the accused Vinesh assaulted with tabal on the head of the mother of informant as a result of which, the mother of the deceased fell down on the ground and died. During investigation, after ten days of the incident, statements of Sonu and Manoj were recorded by the investigating officer in which they have changed the prosecution version and stated that coaccused Vinesh (present applicant) assaulted with brick on the head of the deceased and the deceased has sustained injury and due to which she died. In this way, the prosecution version as made against the applicant in the FIR does not substantiate with the evidence on record. There is no other evidence on record to specify the role of this applicant for causing injury on the head of the deceased. Further submitted that the applicant is minor and declared to be juvenile and he is in jail since 22.10.2018, therefore, requested for bail. In case he released on bail, he will not misuse the liberty of bail and will co-operate in trial.
