This is an application for bail moved on behalf of the applicant, Indu Devi, who is involved in Case Crime No. 17 of 2022, under Sections 498-A, 304-B of I.P.C. and Section 3/4 Dowry Prohibition Act, Police Station- Maharajganj, District- Jaunpur. Learned counsel for the applicant has contended that the applicant is innocent and has been falsely implicated. It is further contended that a very general allegation has been made against all the family members; that the applicant is Jethani. It is further submitted that the applicant being a women is entitled for the benefit which has been provided under the proviso of Section 437 of Cr.P.C. It is further submitted that the applicant has two minor children who have to be cared for. It is further submitted that the charge-sheet has been submitted in the case and no further investigation is required by the police. It is further submitted that the applicant has no other criminal history and is in jail since 18.04.2022 and if he is released on bail, there is no chance of his absconding or misusing the liberty of bail or tampering with the prosecution witnesses.
