Heard Sri Rajesh Mishra, the learned counsel for the applicant, Sri Indra Dev, the learned State Counsel and perused the record.
The instant application has been filed seeking release of the applicant on bail in Case Crime No. 110 of 2022, under Sections 395, 341, 342, 365, 412, 120-B IPC, Police Station Malpura, District Agra during pendency of the trial in the Court below.
The aforesaid case has been registered on the basis of an F.I.R. dated 02.03.2022 lodged against unknown persons alleging that they had robbed two new chassis of Eicher Truck from the informant and his companion.
The Police claims to have recovered a stolen chassis on 10.03.2022 and a car was apprehended and out of five persons sitting in a Car, three persons ran away and two persons were arrested. One of the arrested person Rizwan named five other persons who were involved in the robbery but he did not implicate the applicant. The said accused Rizwan has further stated that he had stolen a Tractor also which was being driven by one of the co-accused Shahrukh and the applicant was said to be sitting on the Tractor.
