Learned counsel for the applicant has contended that the applicant is innocent and has been falsely implicated. It is further contended that the occurrence is alleged to have taken place on 06.10.2020, whereas, FIR was lodged on 22.10.2020 after a great delay of 16 days and no explanation of the same has been given by the prosecution. It is further contended that the body of the deceased was not recovered and in fact it could only be said that ever since 6.10.2020, the person who has been presumed to have died had only disappeared. When the applicant was apprehended by the police on 14.11.2020 it is alleged by the police that from the pointing of the applicant, one Axe, a piece of rope and one slipper of the left Leg were recovered. It is further contended that the recovery was absolutely of no consequence and there is no evidence, which connects the recovered slipper with the deceased / missing person.
