Heard learned counsel for the applicant and the learned A.G.A. for the State and perused the record.
The present bail application has been filed by the applicant in case crime No.540 of 2021, under Section 2/3 of U.P. Gangster and Anti Social (Prevention) Act, 1986, Police Station Katra , District Shahjahanpur with the prayer to enlarge him on bail.
The submission of the learned counsel for the applicant is that applicant is an innocent person and has been falsely implicated in the present case. The applicant is neither a member of any gang nor is involved in any gang activity. It is urged that in the solitary case shown in the gang chart also the applicant has been enlarged on bail by this Court vide order dated 22.12.2021 passed in Criminal Misc. Bail Application No. 39439 of 2021. It has been submitted applicant is in jail since 16.07.2021 and, in case he is enlarged on bail, he will not misuse the liberty of bail.
Learned AGA has opposed the prayer for grant of bail to the applicant, but could not point out anything material to the contrary.
