Heard learned counsel for the applicant; Sri Avinash Pandey, learned counsel for the informant and learned A.G.A. for the State and perused the material on record.

The instant bail application has been filed on behalf of the applicant, Arif , with a prayer to release him on bail in Case Crime No. 73 of 2022, under Sections 364-A, 506, 328, 34 IPC, Police Station Shamli, District- Shamli during pendency of trial.

Learned counsel for the applicant has contended that the coaccused, Parvez, has been granted bail by this Court on 13.7.2022 in Criminal Misc. Bail Application No.18138 of 2022. The case of the applicant stands on identical footing, hence the applicant is also entitled for bail on the ground of parity. The applicant is languishing in jail since 09.02.2022.

Learned AGA and learned counsel for the informant have opposed the prayer for bail, but do not dispute the claim of parity.

Let the applicant involved in aforesaid case be released on bail on furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned with the following conditions which are being imposed in the interest of justice:-
