Short counter and rejoinder affidavits, filed today, are taken on record.
Heard learned counsel for the applicant, Sri Ram Adhar Ram, learned A.G.A. on behalf of State and perused the record.
The instant bail application has been filed on behalf of the applicant with a prayer to release him on bail in Case Crime No.815 of 2021, under Sections 307, 452, 394, 411, 34 I.P.C., P.S. Jewar, District Gautam Budh Nagar, during pendency of the trial.
Learned counsel for the applicant submits that applicant is innocent and has falsely been implicated in the present case. The applicant is not named in the F.I.R. He is not involved in the alleged offence. The main allegation is against co-accused Himmat Singh, who is son of the injured. The applicant is not a previous convict and is languishing in jail since 30.11.2021.
The injured has received following injuries:
1. Entry wound left side temporal region irregular marking bleeding present.
2. Entry would right loumber region blackening present.
3. Multiple L.W. over scalp/occipital region tampoperital, scalp.
4. L.W. over right side fore head size approx 2x1 cm.
The injuries are corresponding the version of F.I.R. and the statement of eye witnesses.
On the other hand, learned A.G.A. vehemently opposed the bail prayer of the applicant contending that injuries received by the injured, are grievous in nature which was caused by fire arm, hence the applicant is not entitled for bail.
Without expressing any opinion on the merits of the case and considering the submission advanced, I find no good ground for grant of bail to the applicant in the aforesaid case.
The bail application is, accordingly, rejected.
However, the trial court is directed to decide the trial of the case in accordance with law, as expeditiously as possible, without granting any unnecessary or long adjournments to either of the parties, preferably, within a period of six months from the date of production of a certified copy of this order, if there is no other legal impediment.
