implicated in the statement given by the injured Golu Sharma much later to the lodgement of the F.I.R. The said statement is unreliable and is an afterthought. The applicant has not been identified as the principal offender who inflicted grievous injuries on the injured or caused the fatal wound on the deceased. Only a general and a vague role has been assigned to the applicant in the said statement. Learned counsel for the applicant contends that the applicant does not have any criminal history apart from this case. Learned counsel for the applicant claims congruency in role and seeks parity in relief granted to other co-accused namely Ankit Sonkar, Keshav Chauhan, Sonu Kumar, Abhay Tyagi, Ekansh Gupta, Ashu Sagar, who have been enlarged on bail by this Court by orders dated 15.12.2021, 20.12.2021, 29.11.2021, 26.11.2021, 08.12.2021, 16.12.2021 in Criminal Misc. Bail Application Nos. 52694 of 2021, 53546 of 2021, 44990 of 2021, 42709 of 2021, 39616 of 2021, 38201 of 2021 respectively. Lastly it is contended by the learned counsel for applicant that the applicant shall not abscond and will fully cooperate in the criminal law proceedings. The applicant shall not tamper with the evidence nor influence the witnesses in any manner.
