By means of this bail application the applicant has prayed to be enlarged on bail in Case Crime No. 82 of 2021 at Police Station Roravar, District Aligarh, under Sections 380, 411 IPC. The applicant is in jail since 08.10.2021.
The bail application of the applicant was rejected by learned Additional District & Sessions Judge, Aligarh, on 09.11.2021.
Shri Mohit Kumar Jaiswal, learned counsel for the applicant contends that the applicant has been falsely implicated in the instant case. The applicant is a lady. Rs. 24,500/- cash has been shown as recovered from the applicant. The money belongs to the applicant. Recovered items were planted on the applicant to frame him in the instant case to show proficiency of the police investigators. There is no independent witness to the alleged recovery. Prosecution evidence does not connect the applicant with the offence. Learned counsel for the applicant contends that the applicant does not have any criminal history apart from the instant case. Learned counsel for the applicant claims congruency in role and seeks parity in
relief granted to co-accused Smt. China who has been enlarged on bail by this Court by order dated 25.02.2022 in Criminal Misc. Bail Application No. 51559 of 2021. Lastly it is contended by the learned counsel for applicant that the applicant shall not abscond and will fully cooperate in the criminal law proceedings. The applicant shall not tamper with the evidence nor influence the witnesses in any manner.
