Learned counsel for the applicant submits that according to the FIR version on 13th July, 2021 at about 07.00 pm. victim aged about 14 years went away from the house, after much search could not be found. A suspicion was raised against the Guljar. He submits that in first statement informant reiterated the version of FIR. In second statement under Section 161 Cr.P.C. informant has disclosed the name of 8 persons including the applicant and co-accused Badshahi and in third statement informant has disclosed the name of 4 persons Anas, Guljar, Furkan and Raheem. The co-accused Badshahi has been granted bail by co-ordinate Bench of this Court vide order dated 05.05.2022 in Criminal Misc. Bail Application No. 7777 of 2022, thherefore, the applicant is entitled for bail on the ground of parity. There is no possibility of the applicant of fleeing away from the judicial process or tampering with the witnesses and, in case, the applicant is enlarged on bail, the applicant shall not misuse the liberty of bail. It is next contended that there is no criminal history of the applicant and he is languishing in jail since 04.08.2021.
