The applicant is the husband of the deceased. Allegations in the F.I.R. records that the deceased was harassed and tortured for dowry. On the fateful day, the deceased called up her parents and informed to come immediately to rescue her life which was under threat. Father of the informant also made emergency call to the police authorities who promptly arrived at the site. The victim had been burnt to death by various accused persons. The victim in her dying declaration has nominated the applicant as the principal offender who set her on fire. The victim died of burn injures. The offence is grave. There is likelihood that the applicant committed the offence.
Considering the nature of the offence, interest of justice will not be supported by enlarging the applicant on bail at this stage. However, justice will be served by directing the learned trial court to expedite the trial within a stipulated period of time.
The bail application is dismissed.
It is informed that only two witnesses have been examined. The trial has been pending for the past five years.The trial cannot continue in this manner. The trial court is under an obligation of law to expedite the trial proceedings. The trial court is directed to conclude the trial within a period of six months from the date of receipt of a certified copy of this order. The learned trial court shall proceed with the hearing on a day to day basis to ensure that the above stipulated
