Learned counsel for the applicant has argued that a first information report has been lodged by Rooman before Police Station- Khurja Nagar, District- Bulandshahr being F.I.R. No. 0936 of 2020 under Section 406 I.P.C. with an allegation that nominated accused had taken four-wheeler from the complainant and thereafter upon being asked to return it, he did not return it back to the complainant. Learned counsel for the applicant has argued that the applicant has falsely implicated in the case in question as he was not named in the F.I.R., however in the statement of one Sri Chhotte, the applicant name has surfaced, wherein it was alleged that the applicant was sitting behind Somvir, who had administered a cold drink containing certain articles which made the nominated accused unconscious and thereafter Somvir was faint. Learned counsel for the applicant has argued that the applicant has falsely been implicated in the present case due to ill-will and malafide intention. Learned counsel has referred to paragraph 12 of the bail application so as to contend in Case Crime No.222 of 2020 under Sections 395, 412, 120-B I.P.C., the applicant stands bailed out in C.M. Bail Application No. 8083 of 2021 passed by the Co-ordinate Bench of this Court, copy of the bail order is available on record. Learned counsel has also sought parity from co-accused Surendra Moga and Chhote, who have already been enlarged on bail by the Co-ordinate Bench of this Court,
