Heard Shri Varinder Singh, learned counsel for the applicants, Sri Ashutosh Upadhyay, learned counsel for the first informant as well as learned A.G.A. for the State and perused the material on record.
The instant Anticipatory Bail Application has been filed with a prayer to grant an anticipatory bail to the applicants, namely, Adil and Jalees in Case Crime No. 230 of 2021, under Sections-323, 324, 308 and 504 IPC, Police Station-Dhanari, District-Sambhal, till the conclusion of the trial, after rejecting the anticipatory bail application of the applicants by Sessions Judge, Chandausi, vide order dated 10.02.2022.
After some argument, learned counsel for the applicants states that he wants to withdraw the application with liberty to file a regular bail application before the court of competent jurisdiction.
In case bail application is filed by the applicants, the same shall be decided in accordance with the judgment rendered by the Supreme Court in Satender Kumar Antil Vs. Central Bureau of Investigation & Another, (2021) 10 SCC 773.
The application stands disposed of as prayed.
