Heard learned counsel for the parties through WebEx Video Conferencing platform and perused the material brought on record.
It is contended by learned counsel for the applicant that applicant is husband of the complainant and has been falsely implicated in the present case with malafide intention just for harassing the applicant. Applicant has not committed the alleged offence.
Learned A.G.A. has vehemently opposed the bail prayer of the applicant and submitted that grounds taken by learned counsel for the applicant are not convincing or special for grant of anticipatory bail to the applicant. It is further submitted that charge sheet against the applicant has been submitted.
After hearing the learned counsel for the applicant and learned AGA, and after perusing the averments made in the present anticipatory bail application as well as rejection order of the court below, this Court is of the opinion, that learned counsel for the applicant could not point out any good ground for grant of anticipatory bail to the applicant. Charge sheet has also been submitted in the present case.
Accordingly, (Anticipatory) Bail Application (under section 438 Cr. P.C.) for grant of anticipatory bail to the applicant- Sameer Sikka, who is involved in Case Crime No. 1429 of 2020, under section- 498A, 323, 504, 506 IPC and 3/4 of D.P.Act, Police Station- Civil Lines, DistrictMoradabad, is hereby rejected, leaving it open to the applicant to take recourse to the remedy available under law.
