Earlier on, the case was adjourned on 14.09.2022 at the request of learned counsel for the applicants.
The anticipatory bail application becomes infructuous, if:-
(a) final report is submitted against the accused;
(b) if the accused-applicants are exonerated by the investigating officer of the charges;
(c) if the accused-applicants are arrested before the grant of interim anticipatory bail;
(d) the applicants are not interested in prosecuting the anticipatory bail application for reasons best known to them or their counsel; or
(e) the applicants in all likelihood was misusing the interim anticipatory bail granted and avoiding appearance before the court.
The Court has not been apprised of the reason of non appearance of anyone to press the present anticipatory bail application.
Therefore, the Court is left with no option but to dismiss this anticipatory bail application for want of prosecution.
The same is dismissed for want of prosecution and being rendered infructuous.
Interim order, if any, stands vacated.
