Sri Vimal Kumar Pandey, learned counsel for the applicant, Sri Arvind Prabodh Dubey, learned counsel for the first informant and learned A.G.A. for the State are present through video conferencing and perused the material on record.

The present anticipatory bail application has been filed on behalf of applicant- Nitin Chhabra under Section 438 of The Code of Criminal Procedure, with a prayer to release him on bail in Case Crime No. 459 of 2020, under Sections 498A, 323, 504, 506 of the Indian Penal Code and Section 3/4 of D.P. Act, registered at Police Station- George Town, District Prayagraj, during pendency of the trial.

Learned counsel for the first informant submits that the present anticipatory bail application has been filed before this Court directly without assigning any sufficient reason.

Learned counsel for the applicant wants to withdraw the application with liberty to file a regular bail application before the court of competent jurisdiction.

In view of the above, the application is dismissed as withdrawn with the aforesaid liberty.
