Heard learned counsel for the O.P. No. 2, learned A.G.A. and perused the record.
This application has been filed with a prayer to quash the entire criminal proceeding of Complaint Case No. 4116 of 2019 (Sana Khanam Vs. Salman and others), under sections 323, 354-B, 452, 504, 506 IPC, P.S. Kithaur,District Meerut.
From the perusal of the order sheet it transpires that this matter was referred to mediation centre of this court vide order dated 4.3.2020, but mediation has been failed due to non appearance of O.P. No. 2 vide report dated 28.09.2021. Also in the present case the learned counsel for the O.P. No. 2 Sri Sudhir Kumar states that he has served the notice to the clerk of learned counsel for the applicants Mohd. Tasleem, but he has replied that he has no instruction on behalf of the applicants.
Considering the facts of the case and report of the mediation centre, this application has no merit, and is hereby dismissed.
